1864 Will & Probate of Joseph BOOTH of Pentrich

----- Will dated 23rd May 1864 -----

I Joseph BOOTH Blacksmith of Pentrich in the county of Derby being weak in body but of sound and disposing mind memory and understanding do this the twenty third day of May one thousand eight hundred and sixty four, make this my last will and testament. I give devise and bequeath unto my brother William BOOTH all those three freehold cottages and appurtenances situate at Liverpool the deeds of which are now in the hands of my brother Charles BOOTH and which he must immediately deliver up to my brother William at my decease. Also all the other property of which I may die possessed real or personal in possession reversion or expectancy for his own sole use and benefit and I appoint my brother William BOOTH and Edwin TURTON or Pentrich executors of this my last will and testament and hereby revoking all other wills by me at any time made, I declare this to be my last will and testament. In witness whereof I the said Joseph BOOTH have hereunto set my hand the day and year above written ~ Joseph Booth ~ Signed by the said Joseph BOOTH in the presence of us, present at the same time

In her Majesty’s court of Probate  The district Registry at Derby

In the Goods of Joseph BOOTH, deceased

I George BRENTNALL of Riddings in the parish of Alfreton in the county of Derby, Builder   make oath that I am one of the subscribing witnesses to the last Will and Testament of Joseph BOOTH late of Pentrich in the county of Derby, Blacksmith deceased, the said Will being now hereunto annexed, bearing date the twenty third day of May one thousand, eight hundred and sixty four and that the said testator executed the said Will on the day of the date thereof by signing his name at the foot or end thereof us the same now appears thereon in the presence of me and of Benjamin HOUSLEY the other subscribed witness thereto both of us being present at the same time and we thereupon attested and subscribed the said Will in the presence of the said testator  George BRENTNALL  sworn by the said George BRENTNAL at Derby in the County of Derby this twenty-ninth day of July 1864 Before me  James VALLACK a Commissioner to administrative Oaths in Chancery in England.

Proved at Derby the fifth of August 1864 by the oath of William BOOTH the brother, one of the executors named in the will to whom administration was granted. Power reserved to Edwin TURTON the other executor in the said will the testator. Joseph BOOTH was late of Pentrich in the county of Derby, Blacksmith and died on the 11th June 1864 at Pentrich aforesaid.
