The Will - Dated 1923 |
|
|
|
This is the Last Will and Testament of me Arthur John TOWLSON of Pentrich in the County of Derby, Cotton Doubler. I revoke all former Wills and Testamentary dispositions heretofore made by me and declare this only to be my Last Will and Testament. I appoint my three sons Percy Henry TOWLSON, Oliver John TOWLSON and Arthur William TOWLSON (hereinafter called “my trustees”) to be the Executors and Trustees of this my will. And I direct my trustees to pay my just debts and funeral and testamentary expenses as soon as conveniently may be after my decease. I give, devise and bequeath all my real and personal estate unto my trustees Upon Trust, to permit my wife to have use and enjoyment of my furniture and household goods and to receive the rents income and profits arising from my real and personal estate, during her life and after her death I bequeath the oil painting of my Mother to my oldest surviving son for his own absolute use and benefit and subject thereto I declare that my trustees shall sell and convert into money, the whole of my said real and personal property including the said furniture and household goods as soon as conveniently maybe after the decease of my said wife, and shall stand possessed of the net moneys arising there from and of my ready money (if any) in trust to pay the same equally between and amongst all my children then living, share and share alike. Provided always and I hereby declare that if any child or children of mine shall die during my lifetime or during the lifetime of my said wife, if she shall survive me leaving a child or children, who shall survive me and my said wife and attain the age of Twenty One years such child or children shall take and if more than one equally between them the share which his or their deceased parent would have taken if he or she had survived me and my said wife and attain the age of Twenty One years. Provided also that if any son of mine shall die during my lifetime of during the lifetime of my said wife, if she should survive me without leaving a child or children who shall survive me and my said wife and attain the age of Twenty One years but leaving a widow who shall survive me and my wife, then such widow shall take one equal half part of the share and interest in my said real and personal estate and the proceeds of sole there of which would have belonged to such deceased son if he had survived me and my said wife and the other half part or share thereof shall form part of my residuary trust funds and be dealt with accordingly. In Witness whereof I have hereunto set my hand this fifth day of February One Thousand Nine Hundred and Twenty Three. |
